These Terms of Service ("Terms") are a binding agreement between you and Tempist LLC, a Pennsylvania limited liability company ("Tempist," "we," "us," or "our"), governing your use of the Tempist Fire Advisor platform, connected hardware devices, mobile and web applications, and related services (collectively, the "Service"). By creating an account, installing a Tempist device, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Tempist Fire Advisor is an Internet-connected telemetry and advisory platform for outdoor wood boilers, indoor wood boilers, biomass heating equipment, and related thermal monitoring applications. Depending on your plan and hardware, the Service may provide live temperature readings, operational history, SMS and email alerts, warranty telemetry, fire-out predictions, and dealer-facing diagnostics.
Tempist devices are Internet-connected sensors designed for installation on wood boilers and related equipment. By purchasing or operating a Tempist device you acknowledge the following:
Some features of the Service require a paid subscription. Current tiers and pricing are published on our website.
California, New York, Oregon, and other state auto-renewal laws apply where your billing address indicates, and those statutes take precedence over anything less favorable in these Terms.
EXCEPT FOR THE LIMITED HARDWARE WARRANTY DESCRIBED IN THE RETURNS & WARRANTY SECTION, THE SERVICE AND ALL SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that notifications will be delivered in all circumstances; that predictions or advisories will be accurate or complete; or that any defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEMPIST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — including property damage, loss of use, loss of data, loss of profits, personal injury, equipment damage, freezing or water damage, or fire damage — arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) ONE HUNDRED U.S. DOLLARS ($100) OR (b) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless Tempist from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
The Service — including all software, firmware, designs, text, graphics, and the "Tempist" name and marks — is owned by Tempist LLC and protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service solely as permitted by these Terms. You retain ownership of the telemetry data generated from your boiler; we retain the right to use aggregated, de-identified data to operate, improve, and benchmark the Service (see Privacy Policy Section 2).
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service, other users' accounts, or our systems; interfere with or disrupt the Service; reverse engineer, decompile, or disassemble firmware or software (except where such restrictions are prohibited by law); or use the Service in a way that could damage or overburden our systems.
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts owed, or use the Service in a way that creates risk or liability for us or other users. You may terminate your account at any time. Sections 5, 6, 7, 8, 11, 12, 13, and 14 survive any termination.
We may update these Terms from time to time. When we make material changes, we will email the address on file and update the Effective Date at the top of this page. Continued use of the Service after the update takes effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Except for claims properly brought in small-claims court, any dispute arising from or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Erie County, Pennsylvania, or through binding arbitration under Section 13.
Except for intellectual-property claims and claims you may bring in small-claims court, any dispute arising from or related to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in Erie, Pennsylvania. The arbitrator's decision is final and binding. You and Tempist agree that any arbitration will be conducted on an individual basis only. Class arbitrations, class actions, private attorney-general actions, and consolidation with other claims are not permitted. If this class-action waiver is found unenforceable, the arbitration provision will be severed in full and disputes will proceed in the courts identified in Section 12.
Opt-out. You may opt out of this arbitration provision by emailing support@tempist.net within thirty (30) days of creating your account, with the subject line "Arbitration Opt-Out" and your full name.
We respect copyright. If you believe content on the Service infringes a copyright you own, send a notice that complies with 17 U.S.C. § 512(c)(3) to our DMCA agent:

This Privacy Policy explains how Tempist LLC ("Tempist," "we," "us," or "our") collects, uses, shares, and protects information when you use the Tempist Fire Advisor platform, connected hardware, and related services (the "Service"). This policy is written for residents of the United States; we describe California-specific rights (Section 8) and EU/UK-specific rights (Section 9) separately.
From connected Tempist devices we collect:
When you create an account we collect your email address, chosen display name, notification preferences, and password hash (we never store passwords in readable form).
If you opt in to SMS notifications, we collect the mobile number you provide, your consent timestamp, and your opt-in source.
Payments are processed by PayPal and Stripe. We do not store full card numbers; we store the last four digits, card brand, and transaction identifiers for receipts and refunds.
We obtain outdoor weather from public weather services using the approximate location you provide during setup (ZIP/postal code, or device GPS if you enable it). We do not continuously track your location.
Our websites use strictly necessary cookies for authentication and basic functionality, and limited analytics cookies to measure aggregate traffic. You can block cookies in your browser; some Service features may stop working if you do.
We share personal information only as described below, and we do not sell your personal information.
These providers act on our written instructions and are bound by confidentiality and data-protection obligations.
If your device was installed by a boiler manufacturer as a factory-installed option, that manufacturer receives warranty-relevant telemetry (hours run, highest/lowest temps, heat cycles, boil and freeze events, firmware version) and inventory status (assigned customer, not-yet-assigned). Manufacturer partners do not receive your mobile number, email, payment information, or live temperature stream unless you explicitly grant access during setup.
We may disclose information to comply with valid legal process, enforce our Terms, or protect the rights, property, or safety of Tempist, our users, or the public.
If Tempist is involved in a merger, acquisition, or asset sale, information may transfer as part of the transaction. We will notify you before any transfer changes the privacy terms.
We encrypt data in transit (TLS) and at rest on our cloud platform. Passwords are hashed with industry-standard algorithms; firmware credentials are stored encrypted. Payment-card data is handled exclusively by PCI-DSS-compliant processors (PayPal, Stripe); Tempist does not store full card numbers. No system is perfectly secure; we require users to choose strong passwords and to report suspected compromises to support@tempist.net.
The Service is not directed to children under 13 and we do not knowingly collect personal information from anyone under 13. If we learn we have collected such information, we will delete it promptly. Contact support@tempist.net if you believe we may have collected information from a child.
California residents have the right to know what personal information we collect, to request deletion, to correct inaccurate information, to opt out of sale or sharing for cross-context advertising, and to limit use of sensitive personal information. We do not sell personal information and we do not share it for cross-context behavioral advertising.
How to exercise these rights: email support@tempist.net with the subject line "California Privacy Request" and tell us which right you are exercising. We will verify your request by matching the account email and will respond within forty-five (45) days. You may designate an authorized agent to submit requests on your behalf. We do not discriminate against users who exercise their privacy rights.
Categories we collect: identifiers (email, mobile number), commercial information (purchases), Internet activity (device diagnostics), geolocation (approximate), and sensor readings.
If you are in the European Economic Area, United Kingdom, or Switzerland, Tempist is the data controller. Our legal bases are contract (to deliver the Service), consent (SMS, marketing), legitimate interests (fraud prevention, product improvement), and legal obligations (tax, compliance). You have the right to access, rectify, erase, restrict, port, and object; you can withdraw consent at any time; and you can lodge a complaint with your local supervisory authority. Contact support@tempist.net. International transfers to U.S. service providers rely on Standard Contractual Clauses where applicable.
We may update this Privacy Policy. When we make material changes we will update the Effective Date and email the address on file at least fifteen (15) days before changes take effect for account holders.

Tempist SMS is utility-only. We do not send marketing, promotional, or advertising text messages, and we do not share your mobile number with third parties for marketing purposes.
Message and data rates from your carrier may apply. Tempist does not charge for SMS; your carrier may charge you for receiving text messages based on your mobile plan. Supported carriers include AT&T, T-Mobile, Verizon, and most U.S. MVNOs. Carriers are not liable for delayed or undelivered messages.
You can opt out at any time.
STOP to any Tempist message to unsubscribe from all SMS notifications. If a Tempist hardware product isn't the right fit, you can return it within thirty (30) days of the purchase date for a refund, as long as it is:

Tempist hardware carries a one-year limited warranty from the date of purchase, covering manufacturing defects in materials and workmanship. If we determine the device is covered, we will repair, replace, or refund at our discretion.
